These Terms of Service ("Terms") govern your use of the Day to Day Dementia website and services, operated by Day to Day Dementia, LLC ("we," "us," or "our"). By using our site or joining our waitlist, you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

To use the website, waitlist, and membership, you must be at least 18 years old and able to form a binding contract. By using the site, you represent that you meet these requirements.

These Terms do not govern our iPhone and iPad game, Day to Day Match 3. The app is distributed by Apple under Apple's standard licensed application end user license agreement, is rated 4+, and may be used by anyone. It has no account and collects nothing — see the app privacy policy.

2. Not medical care — important disclaimer

Day to Day Dementia provides peer support, companionship, and education only. It is not medical, psychiatric, or crisis care, and it is not a substitute for advice, diagnosis, or treatment from a qualified professional. Using our site does not create a provider-patient relationship. Always consult your or your loved one's care team for medical decisions, and never disregard or delay professional advice because of something you read or hear through our services.

If you or someone you love may be in danger or experiencing a crisis, call or text 988 (the Suicide & Crisis Lifeline) or your local emergency number, or go to the nearest emergency room. Our content, including meditations and articles, is for general educational and supportive purposes.

3. The waitlist

Joining the waitlist lets us notify you about our launch. It does not guarantee that any product, feature, price, or launch date will be offered, and all of these may change. We may discontinue the waitlist at any time.

4. Accounts & lifetime membership

When membership becomes available, you may need to create an account. You are responsible for keeping your login credentials secure and for activity under your account. "Lifetime access," where offered, means access for the operational lifetime of the Day to Day Dementia service; it does not mean perpetual access irrespective of whether the service continues to operate, and it is personal to you and non-transferable unless we state otherwise.

5. Payments & refunds

Paid memberships are billed through a third-party payment processor, whose terms also apply. Prices and applicable taxes will be shown at checkout. Founding-member and promotional pricing may be time-limited and subject to additional conditions stated at the time of purchase.

6. Acceptable use & community conduct

To keep our community safe and supportive, you agree not to:

We may moderate, remove content, and suspend or terminate accounts that violate these Terms. Where the community allows anonymous posting, you remain responsible for your conduct and content.

7. Your content

You retain ownership of content you post. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and use that content as needed to operate and improve the service. You represent that you have the rights to the content you post and that it does not violate these Terms or the rights of others. We may remove content at our discretion.

8. Our intellectual property

The Day to Day Dementia name, logo, website, articles, guides, and original meditations are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-commercial license to access and use them for your own caregiving support. You may not copy, redistribute, sell, or create derivative works from our content without our written permission.

9. Third-party services & links

Our services rely on and link to third parties (for example, analytics, payment, community-platform, and external resources). We are not responsible for third-party services or websites, and your use of them is governed by their terms and policies.

10. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that content is accurate, complete, or current.

11. Limitation of liability

To the fullest extent permitted by law, Day to Day Dementia, LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service or reliance on its content. Our total liability for any claim relating to the service will not exceed the amount you paid us in the twelve months before the claim, or USD $100 if you have not paid us.

12. Indemnification

You agree to indemnify and hold harmless Day to Day Dementia, LLC and its personnel from claims, damages, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms or the rights of others.

13. Termination

You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Washington, unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
